End-User License Agreement (“Agreement”)

Interpretation
Words with initial capital letters have meanings defined under the following conditions. These definitions apply regardless of whether they appear in singular or plural forms.
Definitions
Agreement: This End-User License Agreement that forms the entire agreement between you and HV Grounded regarding the use of the services or digital tools provided.
Application: Any software, tools, or digital platforms provided by HV Grounded that you access or use on a device.
Company: Refers to HV Grounded, located at 3665 Albany Post Road, Poughkeepsie, NY 12601, referred to as “the Company,” “We,” “Us,” or “Our.”
Content: Any text, images, or other materials posted, uploaded, linked to, or otherwise made available through our platform by users.
Device: Any device such as a computer, smartphone, or tablet that can access the Application or website.
Third-Party Services: Any services or content provided by a third party that may be displayed, included, or made available by the Application.
You: The individual accessing or using the Application or the legal entity on behalf of which such individual is acting.
Acknowledgment
By clicking “I Agree,” accessing, or using the Application, you confirm that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, do not use the Application or services.
This Agreement constitutes a legal agreement between you and HV Grounded regarding the use of our services, tools, or platform.
License
Scope of License
We grant you a revocable, non-exclusive, non-transferable, limited license to access and use our services or Application strictly in accordance with this Agreement.
Restrictions
You agree not to:
Sell, rent, lease, or commercially exploit our services or Application.
Copy, modify, or create derivative works of our tools or services.
Reverse engineer or decompile the Application.
Remove or alter any copyright or trademark notices.
Content
You are solely responsible for the content you upload, post, or share through our platform. Prohibited content includes, but is not limited to:
Unlawful or offensive materials.
Spam or unauthorized advertising.
Harmful software like viruses or malware.
HV Grounded reserves the right to remove any content that violates this Agreement and may limit or terminate your access to the platform.
Privacy Policy
Your information is collected and managed in accordance with our Privacy Policy. By using our services, you agree to the terms outlined in the Privacy Policy.
Modifications and Updates
We reserve the right to modify or discontinue any features of the Application or services without prior notice. Updates may change functionalities, and continued use of our services indicates acceptance of these updates.
Limitation of Liability
HV Grounded provides services “as is” without any warranties, express or implied. We are not liable for any damages, including data loss or interruptions, resulting from the use of our platform or tools.
Termination
This Agreement remains in effect until terminated by either party. You may terminate it by ceasing use of our services. We reserve the right to suspend or terminate access for violations of this Agreement.
